C\u2019est elle qui signe le contrat de travail, verse le salaire, pr\u00e9l\u00e8ve et reverse les cotisations sociales, et assure le consultant contre les risques professionnels. Elle peut \u00e9galement g\u00e9rer l\u2019obtention des permis de travail pour les \u00e9trangers et frontaliers.<\/p>\n\n\n\n<p>Le client final, de son c\u00f4t\u00e9, b\u00e9n\u00e9ficie des comp\u00e9tences du consultant sans avoir \u00e0 \u00e9tablir de lien contractuel direct, ce qui lui permet de r\u00e9duire les risques juridiques (notamment celui du \u00ab faux ind\u00e9pendant \u00bb) et de gagner en flexibilit\u00e9. Ce syst\u00e8me est tr\u00e8s utilis\u00e9 dans les missions temporaires, les renforts de projets, ou pour des profils sp\u00e9cialis\u00e9s que l\u2019entreprise souhaite engager sans augmenter son \u00ab headcount \u00bb.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le portage salarial : un mod\u00e8le fran\u00e7ais<\/h2>\n\n\n\n<p>N\u00e9 en France dans les ann\u00e9es 1980, le portage salarial repose sur un autre texte : le\u00a0<strong>Code du travail<\/strong>\u00a0(articles L1254-1 \u00e0 L1254-31), compl\u00e9t\u00e9 par une convention collective sp\u00e9cifique. L\u00e0 encore, il s\u2019agit d\u2019un contrat tripartite entre le consultant, l\u2019entreprise de portage et le client final.<\/p>\n\n\n\n<p>Le consultant, appel\u00e9 \u00ab salari\u00e9 port\u00e9 \u00bb, signe un contrat de travail avec la soci\u00e9t\u00e9 de portage. Celle-ci facture le client final et reverse ensuite un salaire au port\u00e9, apr\u00e8s d\u00e9duction des frais de gestion et des charges sociales fran\u00e7aises (URSSAF, retraite, assurance ch\u00f4mage, etc.).<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">Probl\u00e8me<\/span> : en Suisse, ce mod\u00e8le\u00a0<strong>n\u2019est pas reconnu<\/strong>. Il ne figure ni dans le Code des obligations, ni dans la loi f\u00e9d\u00e9rale sur la location de services. Les autorit\u00e9s (SECO, assurances sociales) consid\u00e8rent donc le portage comme\u00a0non conforme.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Des diff\u00e9rences fondamentales \u00e0 plusieurs niveaux<\/h2>\n\n\n\n<p>M\u00eame si l\u2019objectif est similaire \u2014 permettre \u00e0 un ind\u00e9pendant de travailler pour un client via un tiers employeur \u2014, les diff\u00e9rences entre payrolling suisse et portage salarial fran\u00e7ais sont majeures.<\/p>\n\n\n\n<p><strong>Sur le plan juridique<\/strong>, les deux dispositifs reposent sur des lois distinctes et totalement ind\u00e9pendantes l\u2019une de l\u2019autre : la LSE en Suisse, le Code du travail en France.
